Why Netanyahu’s Reported ICC Dossier Against Erdoğan Faces Major Legal Hurdles

Reports that Benjamin Netanyahu directed Israeli officials to prepare a possible International Criminal Court (ICC) case against Turkish President Recep Tayyip Erdoğan describe a dossier in preparation—not a prosecution. The allegations reportedly concern Turkey’s treatment of Kurds and alleged support for Hamas; they have not been established by the reporting, and no ICC filing had been reported as of September 27, 2026. 2

A reported response in a wider dispute

The immediate backdrop was Turkey’s announcement that it would seek an Interpol Red Notice for Netanyahu in connection with a Turkish criminal case over Israel’s interception of a Gaza-bound aid flotilla. An Interpol request is separate from an ICC proceeding; Turkey’s announcement does not, by itself, mean that Interpol issued a notice. 110

The Israeli dossier was reported after that move, but the timing does not prove Netanyahu’s motive. It came amid broader tensions: Erdoğan criticized Israel over Gaza, while Netanyahu rejected genocide accusations and accused Turkey of hosting Hamas leaders. Turkish officials rejected Netanyahu’s accusations as baseless. 17

In that setting, preparing a dossier may serve as a political signal or a way to redirect international attention. That is an interpretation of the timing, not a confirmed explanation from Netanyahu or proof that a case can proceed. 2

Why an ICC case would face hurdles

Preparing a file does not open an ICC case. The Court’s prosecutor independently evaluates information and jurisdiction. People, organizations and governments can provide information, but the Rome Statute’s referral routes include referrals by a State Party or the UN Security Council, as well as an investigation initiated by the prosecutor. 6

The Court needs a jurisdictional basis. The ICC may exercise jurisdiction when relevant crimes are committed on the territory of a State Party or a state that has accepted its jurisdiction, or by a national of such a state. A UN Security Council referral is another route. Turkey is not a party to the Rome Statute, and reporting also identifies Israel as a non-party. That does not automatically rule out ICC jurisdiction, but it makes the location of the alleged conduct and any applicable jurisdictional link crucial. 414

The allegations would have to fit crimes the Court can prosecute. The ICC’s remit covers genocide, crimes against humanity, war crimes and aggression—not every serious allegation or political dispute. Prosecutors would need evidence of a specific crime within that remit and of Erdoğan’s individual responsibility. An allegation of financial support for Hamas, standing alone, does not establish either. 6

A diplomatic signal, not a prosecution yet

The reports describe officials assembling allegations, not an ICC investigation, charge or warrant. Without a clear jurisdictional route and evidence meeting the Court’s legal standards, the dossier’s immediate significance may be political: it adds to an escalating exchange between Ankara and Jerusalem. Whether it could advance beyond that remains uncertain. 26
