EU Parliament Blocks Soy Biofuel Phaseout: The $5.6 Billion WTO Gamble

The Parliament's ITRE Committee (Industry, Research and Energy) voted to recommend rejection, backed by a Motion for Objection from the EPP and ECR political groups . The full plenary then voted to block the delegated act on 7-9 July 2026 .

Why Parliament blocked the soy phaseout

Four main arguments carried the day:

• Strategic feed and protein security — The European Biodiesel Board (EBB) and FEDIOL argued that classifying soy as high-ILUC risk would disrupt the EU's soy supply chains, which are essential for animal feed and protein production . Consequences for WTO compliance

The WTO picture is complex and partly contradictory, and the Parliament's vote has made it worse.

• Malaysia's case (DS600) — A WTO panel largely upheld the EU's RED II legal framework, but found that certain aspects of the Delegated Act's design and implementation were inconsistent with WTO rules . The EU won on the broad architecture but was told to fix specific discriminatory elements.

• The core problem — By blocking the soy phaseout while the palm oil phaseout remains in place, the EU creates an appearance of discriminatory treatment: palm oil is banned, soy is not. Trade retaliation from Indonesia and Malaysia

This is the most acute and immediate consequence of the Parliament's vote.

• Indonesia has already filed for suspension of concessions — In March 2026, Indonesia notified the WTO that it would seek retaliatory trade sanctions against the EU over the palm oil biofuel dispute, citing the EU's failure to comply with the WTO ruling . Consequences for EU domestic agriculture

The impact on Europe's farming and biofuel sectors is mixed.

• Support for European soybean growers — UFOP welcomed the Parliament's vote, arguing that classifying soy globally as high-ILUC risk would have undermined incentives for European farmers to expand domestic soybean production . The rejection preserves the market for EU-grown soy as a biofuel feedstock.
• Rapeseed and other oilseed producers benefit — By keeping soy biofuels eligible, the Parliament avoids sudden shifts in demand that would hit EU rapeseed biodiesel producers, who compete in the same biofuel market. The trilemma the EU now faces

The Parliament's decision creates a three-way tension that has no easy fix:

1. Blocking the soy phaseout shields EU agriculture and avoids immediate WTO claims from soy exporters.
2. But it simultaneously weakens the EU's legal position in the palm oil WTO disputes, emboldening Indonesia and Malaysia to seek billions in retaliation.
3. And it undercuts the EU's proclaimed climate ambition on deforestation-linked biofuels, creating a credibility gap with environmental stakeholders and trading partners alike.

This trilemma is unlikely to be resolved soon. The Council of the EU must now decide whether to accept the Parliament's objection or attempt to revive the delegated act. Either path carries significant political and legal costs.
